My question is: would you drive an unregistered car, with no insurance and no licence, just to get where you need to be?
In most cases the answer is going to be No, unless you want a lot of additional grief in your life.
So why, if a business has the correct Terms Of Trade in place and the ability to Register on their clients PPSR file, don't some businesses take the time to become Secured Creditors against the credit they extend?
The number of times I am asked “are registrations retrospective?†is amazing. In short, the answer is unfortunately, NO!
And add to this the times I have heard “oh I didn't register on my clients PPSR because he has, or they have, always paid in the past†also astounds me. So take note:
IT IS THE ONE YOU DON'T SEE COMING THAT WILL BURN YOU…
Just a word to the wise; this PPSA legislation has a two edged sword attached, one edge for the unsecured, and one for the secured.
I know which edge I would rather have working for me.
